الملخص

This article is intended to highlight the legal status occupied by the Prime Minister in the Algerian constitutional system including his fictive and real powers of indicating the limits of controls and restrictions constitutionally imposed upon , especially after the constitutional amendment of 2008 and 2016 on its constitutional position ,we intend also to analyze the nature of the relationship between the prime minister and the President of the Republic with a comparative study on the subject of the French system ;And the study have come of the most important results Before the constitutional amendment, the head of the government had the privilege of a constitutional position under the constitutional provisions , but the political practice has imposed subservience to the President of the Republic not only under the nomination and revocation of its functions , but also regarding of exercising his powers. The2008th and 2016th amendment came to remove the position he had, and replace that by first minister assistant was occupied earlier as First Minister Assistant to the President of the Republic in charge of the implementation of the program, and he is dually responsible on behalf of parliament and responsible on behalf of the President of the Republic.
