حقوق الطالب الجامعي –قانون مضبوط وواقع مفروض-

الملخص
تنتهي مرحلة التعليم الثانوي بتتويج الطالب بشهادة الباكالوريا التي تمكنه من الولوج لمختلف الجامعات والمعاهد والمراكز الجامعية لمواصلة مشواره العلمي الأكاديمي وحتى المهني في بعض الشعب، فمرحلة التعليم العالي تشكل أحد أهم المراحل في المسار البيداغوجي للطالب والتي من خلالها يكتسب هذا الأخير زادا علميا متخصصا في الميدان والشعبة التي وجه أو توجه إليها، وعليه فإن لكل شخص يحمل صفة الطالب الجامعي حقوقا تتضمنها مختلف القوانين والتنظيمات التي لها علاقة بالوسط الأكاديمي والجامعي، والمفروض أن أول ما يجب تلقينه لمن تطأ قدماه الصرح الجامعي هي الحقوق التي يتمتع بها والواجبات التي تفرض عليه، لكن الواقع المغاير الذي قد يكون في نظرنا هو الاستثناء أصبح أصلا متواترا لدى مسؤولي الهيئات الإدارية والأكاديمية نظرا لما نشهده اليوم من انتهاك وخرق للمنظومة القانونية التي تسير العلاقة بين الطالب والأستاذ والطالب والمكلفين بالمهام الإدارية لدى الجامعات والهياكل التابعة لها، فأصبحنا أمام عدة مشكلات تمس الجانب البيداغوجي والأكاديمي بالدرجة الأولى لتصل لصميم الآداب والأخلاقيات الجامعية والقيم التي من المفروض أن تكون الجامعة واجهة يرى من خلالها مدى الرقي والتطور البشري والأخلاقي الذي وصل إليه المجتمع. The secondary education stage ends with the student being crowned with a baccalaureate degree, which enables him to enter various universities, institutes and university centers to continue his academic and even professional career in some areas. The higher education stage constitutes one of the most important stages in the student’s pedagogical path, through which the latter acquires specialized academic support in the field and division. To which it was directed, every person who holds the status of a university student has rights included in the various laws and regulations that have to do with the academic and university community. It is assumed that the first thing that must be taught to anyone who sets foot in a university building is the rights that he enjoys and the duties that are imposed on him as a holder of the status of a university student, but The different reality, which in our view may be the exception, has become a frequent occurrence among officials of administrative and academic bodies due to the violation and violation we are witnessing today of the legal system that governs the relationship between student, professor, student, and those charged with administrative tasks at universities and their affiliated structures. Thus, we are faced with several problems affecting the pedagogical and academic aspects. Primarily, to reach the core of university ethics and values, which the university is supposed to be a facade through which one can see the extent of human and moral sophistication and development that society has achieved.
