الوساطة كآلية لحل النزاع الأسري في التشريع الجزائري

الملخص
ملخص: النزاعات الاسرية اولي القضايا التي تطرح علي القضاء وتكثر فيها النزاعات من دون ان تجد حلا لها ,واذا كان الحق في التقاضي من الحقوق المضمونة للمتقاضين في التشريعات الدولية والتشريعات الوطنية , لارتباطها بحقوق الانسان وفان حل النزاعات المطروحة امام القضاء لا يمكن حلها في الغالب قضائيا , بالأخص قضايا شؤون الاسرة , فقد يلجأ لحلها بطرق بديلة كالصلح والتحكيم المنصوص عليهما في التشريع الجزائري ,غير انه من الوارد ايضا ان طرق اخرى اثبتت جدارتها في حل النزاعات الاسرية ومنها الوساطة التي اصبحت الوسيلة المهمة في حل النزاع والحفاظ علي العلاقات الاسرية من التفكك ,من خلال هذا الطرح يمكن ان يظهر لنا الاشكال التالي فيما تتمثل الوساطة وما مدى امكانية العمل بها في التشريع الجزائري ؟ يمكن معالجة هذه الاشكالية ضمن محورين المحور الاول الوساطة وصلتها بالنزاع الاسري، المبحث الثاني مدي امكانية العمل بالوساطة في التشريع الجزائري . Summary: Family disputes are the first issues that are brought before the judiciary, and conflicts abound in them without finding a solution to them, and if the right to litigation is one of the rights guaranteed to litigants in international and national legislation, due to its connection to human rights, then resolving disputes before the judiciary cannot often be resolved judicially. Especially family affairs issues, he may resort to resolving them in alternative ways such as conciliation and arbitration stipulated in Algerian legislation, but it is also possible that other methods have proven their worth in resolving family conflicts, including mediation, which has become the important means in resolving the conflict and preserving family relations from disintegration, from Through this proposition, the following forms can be shown to us: What is mediation and what is the extent of the possibility of working with it in Algerian legislation? This problem can be addressed within two axes, the axis of mediation and its connection to the family conflict. The second topic is the extent of the possibility of mediation in Algerian legislation.
