ضوابط الفتوى بما جرى به العمل من خلال قراءة في فتوى الكد والسعاية للقاضي ابن عرضون ورد العلامة عبد القادر الفاسي

الملخص
ملخص : لقد عرف عن المالكية وأهل المغرب على وجه الخصوص اشتغالهم بأحكام النوازل والمسائل، ودرايتهم بالأقضية والأجوبة، وبراعتهم في تطبيق وتنزيل أحكام الشريعة على ما يستجد من الأحداث بما يلائم الزمان والمكان من خلال إيجاد قواعد جديدة للتّخريج الفقهي ، ومن ذلك قاعدة: الأخذ بما جرى به العمل، ولمّا كان العمل بهذه القاعدة غير مألوف عند متقدمي الفقهاء، وكان يفتقر إلى ما يقويه من الإعتبارات الشرعية عمد أكثرهم إلى وضع ضوابط له تمنع من أن يكون حجّة بيد أهل التّشهي والأهواء من المفتين والقضاة، ولبيان ذلك عمدت في هذا المقال إلى إبراز أهم هذه الضوابط والقيود التي تمنع الشذوذ في الفتوى من خلال قراءة بسيطة في فتوى العلامة محمد بن عرضون المغربي التي أطلقها بخصوص حق المرأة في مال زوجها الذي عملت فيه ونمّته، ويسمى بحقّ الشقا أو حقّ الكد والسعاية، مع ذكر ردود العلامة عبد القادر الفاسي عليه وإبراز أهم الجوانب التي اعتمدها في إبطال هذه الفتوى، وأهم الضوابط التي وضعها لذلك . Abstract: It is well-knoun about the malikis in general and people of maghreb in particular their dealing with the mulings of calamities and judjements, issues and their solutions and also they are skillful in addressing matters of sharia by adopting rules or rulings comserning calamities and events that are being accelerated by time which is passing rapidly . They are the first to find out new rules for jurisprudencial graduations which is able to go in comformity with the current events that are emerging rapidly for instance the rule of applying that which has been commonly applied but since the application of this rule is still un common among most of the jurists because of the need to be streng the end by certain legal considerations , most of then decided to set up some conditions ( workable conditions) to prevent those who feblow their desires and lust from using it as an argument in their hands and so that the job of mufti can be clear and to the point to show that a stated in this article the most important conditions and restrietions that can prevent aramalies in fatwas through a swiple reading of allama mohammed aradon,s fatwas which he launched regarding the woman,s right in her husband wealth that she uses and causes it to grow so- called the right of hard work not her share in inheritance – which allama aradon changed from the most reliable thought in jurisprudence .
