الملخص
ملخص: إن القول بما جرى به العمل هو نزوع نحو اتباع المصلحة المعتبرة، وتنزيل الأحكام على وفق الملابسات والظروف العرفية التي يسير عليها المجتمع، ويعد هذا الأخير فيصلا في التفريق بين ما يقوله المفتي مسايرة لأعراف وزمانه، ومسايرتهم دون الأخذ بعين التشريع في ذلك، وهذا هو عين الهوى بلا ريب، وبين ما يفتي به بناء على استحضار منظومة المقاصد القائمة على سد الذرائع، والنظر في مفاسد الأمور ومصالحها. Abstract: To say what the work has done is a tendency to follow the interest under consideration and to apply the decisions according to the customary circumstances and the circumstances that the society follows, and the latter are considered to be the decisive difference between what the mufti says in accordance to the customs and his time, and keep pace with them regardless of the legislation in this, and it is the same passion no doubt, and what he gives fatwas based on the invocation of the goal system based on the blocking of pretexts, the choice of results and the examination of the evils and interests of business.
