الشيخ عبد القادر الفاسي ومنهجه في الفتوى من خلال أجوبتـه الفقهية

الملخص
تتناول هذه الدِّراسة كتابين من كتب المالكيّة في مجال الفتوى للشّيخ عبد القادر الفاسيّ، المتوفَّى عام 1091هـ/1596م، قام من خلالها الباحث بترجمة المؤلِّف فتطرّق إلى جوانب من حياته الاجتماعيَّة والعلميَّة، ثمّ عرَّف بكتابيه من حيث عددُ الأجوبة وطبيعة موضوعاتها، وركَّز على بيان منهج المؤلِّف الذي سلكه في أجوبته الفقهيّة، وخَلُصَ البحث أنَّ المنهج العامّ للمؤلِّف في الفتوى تميّز بالوضوح والشُّموليّة والدِّقّة العلميَّة، وأنَّ منهجه في الاستدلال كان منهجاً أصيلًا يقوم على الدّليل الشّرعيّ والنّظر المقاصديّ، ممّا يبوِّئ أجوبته الفقهيّة كأحد أهمِّ فتاوى كتب المذهب. There have been multiple jurisprudential doctrines throughout the history of Islamic jurisprudence that differed in the application of judgments to emerging facts and calamities owing to the difference in their approaches and inferential methods. The latter helped the appearance of approaches for consideration and fatwa within each doctrine. Additionally, a number of scholars and muftis emerged for each approach and based their jurisprudence judgments on viewing these approaches and knowing its methods in treating matters which enriched the jurisprudence sciences and enabled it to find solutions to every calamity or misfortune. In the present paper, I shed some light on the impact of scientific methods in issuing fatwas by working on Abdelkader El-Fassi, a scholar of fatwa in the Arab Maghreb, considering a number of his fatwas collected by his father Imam Abd El-Rahman in the so-called short and long answers to clarify his approach towards fatwa and the conduct of this honorable sheikh in the fatwa to help and facilitate access to jurisprudence judgments and solutions to problematic issues.
