الحماية القانونية للطفل ضحية الهجرة غير الشرعية

الملخص
يضطر الأطفال إلى مغادرة بلدانهم بطريقة غير شرعية،لعدة أسباب أهمها عدم الإستقرار الأمني والظروف الإجتماعية التي تدفع بهم للبحث عن حياة أفضل فيتعرضون خلال هجرتهم لمخاطر عديدة قد تصل إلى حد الموت ناهيك عن وقوعهم ضحايا لعدة جرائم كالعنف، وسوء المعاملة، والإهمال، والإستغلال، وتهدف هذه الدراسة إلى تبيان مدى التزام الدول المستقبلة بالمبادئ الدولية المقررة لحماية الأطفال المهاجرين بطريقة غير شرعية بالإضافة إلى الأليات الدولية المتاحة لحماية الأطفال المهاجرين بطريقة غير شرعية، مع إبراز دور المحكمة الأوروبية لحقوق الإنسان في حماية الأطفال ضحايا الهجرة غير الشرعية من خلال العديد من قراراتها التي أدانت فيها الدول المستقبلة بسبب انتهاكها للحقوق المقررة للأطفال المهاجرين بطريقة غير شرعية ، وقد توصلنا من خلال هذه الدراسة إلى أنه ورغم إقرار العديد من المبادئ الدولية المقررة لحماية الأطفال المهاجرين إلا أنهم وفي الواقع يتعرضون لشتى أنواع الاستغلال، إذ يعد الاتجار بالبشر لأغراض جنسية، أو اقتصادية، أو نزع الأعضاء، وأشكال العنف الأخرى من أخطر الانتهاكات التي يقعون ضحيتها. :Abstract Children are forced to leave their countries with illegally way for several reasons,the most important of which is security instability and the social situation that push them to search for a better life,during their migration they are exposed to many dangers that may amount to death,not to mention that they are victims of several crimes such as violence, ill-treatment, neglect and exploitation, this study aims to show the extent of the receiving countries commitment to the international principles established for the protection of illegal immigrant children, in addition to the available international mechanisms for the protection of illegal immigrant children, while highlighting the role of the European court of human rights in protecting child victims of illegal migration through many of its resolutions in which it condemned the receiving countries for violating the rights of illegal immigrant children, and we have concluded through this study that despite the adoption of many interational principles established for the protection of immigrant children, they are, in fact, exposed to various types of exploitation, trafficking in human beings for sexual or economic purposes or the removal of organs and other forms of violence are among the most serious violations of which they fall victim.
