المرصد الوطني كآلية للوقاية من التمييز وخطاب الكراهية وفقا للقانون 20/05 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما

الملخص
نظرا لانتشار ظاهرة التمييز وخطاب الكراهية في المجتمع الجزائري والذي يعمل على تحفيز مشاعر الحقد والكراهية والضغينة عند فئة معينة بسبب العرق أو الدين أو اللغة أو اللون وغيرها، الأمر الذي دفع بالمشرع الجزائري إلى إصدار نظاما قانونيا خاصا بتجريم التمييز وخطاب الكراهية من خلال القانون 20/05، هذا الأخير تضمن شقان الشق الأول وقائي لهذه الظاهرة والشق الثاني علاجي ردعي. وتهدف دراستنا إلى تسليط الضوء على الجانب الوقائي بحيث استحدث القانون 20/05 آلية وقائية تتمثل في المرصد الوطني للوقاية من التمييز وخطاب الكراهية، والذي يعتبر هيئة وطنية تتمتع بالشخصية المعنوية والاستقلال المالي والإداري، تحرص على رصد حالات التمييز وخطاب الكراهية وإخطار الجهات المعنية بذلك مع تحليلهما وتحديد أسبابهما واقتراح التدابير والإجراءات اللازمة للوقاية منها. Due to the spread of the phenomenon of discrimination and hate speech in Algerian society, which works to stimulate feelings of hatred, and resentment among a certain group because of race, religion, language, color and others, which prompted the Algerian legislator to issue a special legal system to criminalize discrimination and hate speech through Law 05/20 , the latter included two parts: the first is a preventive part of this phenomenon, and the second is a curative deterrent. Our study aims to shed light on the preventive aspect, as Law 05/20 created a preventive mechanism represented by the National Observatory for the Prevention of Discrimination and Hate Speech, which is a national body that enjoys moral personality and financial and administrative independence, keen to monitor cases of discrimination and hate speech and notify the concerned authorities with their analysis. Determining their causes and proposing the necessary measures and measures to prevent them
