التّأويل المقاصدي لدى الحداثيين. -مقصد الحريّة نموذجا-

الملخص
يتناول المقال بالدّراسة موضوعا حول التّأويل المقاصدي لدى الحداثيين. -مقصد الحريّة نموذجا, لذا جاءت الإشكالية المطروحة في هاته الدراسة: هل ما يدعو إليه الحداثيّون من تأويل مقاصديّ يمثّل صورة ومسلكا صحيحا للتأويل؟ وللإجابة عنها تم التطرق إلى: التّأويل ومقاصد الشّريعة لدى الحداثيين من خلال بيان مفهوم التّأويل المقاصدي والحداثة, ومعرفة مسالك التّأويل في الفقه الإسلامي ولدى الحداثيّين, ثم تناول مقصد الحريّة والتّأويل المقاصدي من خلال التطرق إلى مقصد الحرّية في الفقه الإسلامي ولدى الحداثيّين, والتأويل المقاصدي للحرّيّة, ثم ختمت الدراسة بنماذج تطبيقيّة حول تأويل الحداثيين النّصوص انطلاقا من مقصد الحرّيّة. وخلصت الدّراسة إلى عدّة نتائج أهمّها: أن الحداثيّين يدعون إلى تغليب العقل، بل جعله الحَكَم على النّصوص مهما كانت درجتها دينيّة أو بشريّة، حيث يبدو من خلال ما يدعون إليه بأنّ مشكلتهم الأساسيّة هي النّص، والذي يجب إعادة قراءته وفق مناهج حديثة غربيّة والابتعاد عن التّقليد، وفي الحقيقة هم يرمون إلى التّخلّص منه. The article deals with the study of a topic about the interpretation of the purposes of the modernists. - The purpose of freedom is a model, so the problem raised in this study came up: Does what the modernists call for in terms of the interpretation of my intentions represent a correct image and path for interpretation? In order to answer it, the interpretation and the purposes of the Sharia among the modernists were addressed by clarifying the concept of the interpretation of the intentions and modernity, and knowing the paths of interpretation in Islamic jurisprudence and among the modernists, then dealing with the purpose of freedom and the interpretation of the objectives by addressing the purpose of freedom in Islamic jurisprudence and among the modernists, and the interpretation of the objectives of freedom, Then the study concluded with applied models on the interpretation of texts by the modernists based on the purpose of freedom. The study concluded with several results, the most important of which are: that modernists call for the primacy of reason, and even make it the judgment of texts, regardless of their religious or human degree, as it appears through what they call for that their main problem is the text, which must be re-read according to modern Western approaches and to move away from imitation. In fact, they intend to get rid of it.
