الملخص
يعتبر العقد الإلكتروني العصب الأساسي للتجارة الإلكترونية لأنه يمثل ترجمة قانونية لتلاقي مقدم الخدمة من جهة ومستهلك الخدمة من جهة أخرى، غير إن العلاقة التي تربطهما تمتاز بعدم وجود توازن بينهما كون أن المستهلك الإلكتروني يعتبر الطرف الأضعف في العلاقة التعاقدية حيث إن هذا الخلل أدى إلى توافر صفة الإذعان، وعليه فإن العقد الإلكتروني يضع وجها لوجه طرفين يقف كل منهما على طرفي النقيض من حيث مراكز القوى الاقتصادية، غير أن هذه التحديات الاقتصادية أصبحت ظاهرة لا يمكن غض الطرف عن معالجتها فاستلزمت توافر الحماية القانونية للأطراف الضعيفة بشكل ينسجم مع المنهجية السائدة والتي تسلب مختلف أوجه اختلال التوازن العقدي إذ تعتبر الحماية صمام أمان من مخاطر التعاقد الإلكتروني لتحقيق التوازن بين هيمنة وسطوة الأقوياء وبين حاجة وضعف المذعنين The electronic contract is considered the main nerve of electronic commerce because it represents a legal translation of the meeting of the service provider on the one hand and the consumer of the service on the other hand, however, the relationship that binds them is characterized by the lack of balance between them, since the electronic consumer is considered the weakest party in the contractual relationship, as this imbalance led to the availability of an adjective acquiescence Accordingly, the electronic contract puts two parties face to face, each of which stands on opposite sides in terms of the centers of economic power. However, these economic challenges have become a phenomenon that cannot be turned a blind eye to addressing them, so it necessitated the availability of legal protection for weak parties in a manner consistent with the prevailing methodology that robs the various aspects of imbalance Nodal, as protection is considered a safety valve from the dangers of electronic contracting to achieve a balance between the dominance and sway of the powerful and the need and weakness of the submissive.
