المسؤولية التأديبية للأطباء الممارسين في مرفق الصحة العمومي

الملخص
ملخص: - يخضع الأطباء الممارسين لدى المرفق الصحة العمومي عند إرتكابهم للخطأ تأديبي إلى المسؤولية التأديبية من قبل الهيئات النقابية لمهنة الطب والتي تتمثل في المجلس الوطني ،والمجالس الجهوية، ومن قبل المرفق الصحة العمومي(الإدارة المستخدمة). و يمكن مساءلة الطبيب تأديبيا حتى و إن شكل هذا الخطأ خطأ جزائيا،كما يمكن أن تقوم المسؤولية التأديبية للطبيب حتى في حالة لم ينتج خطأه أي ضرر للغير. - وتهدف هذه الدراسة إلى تسليط الضوء على النظام التأديبي للأطباء الممارسين في المرفق الصحة العمومي،وإبراز الجدوى من السلطة التأديبية في ردع الأطباء. - ومن أهم نتائج التي توصلنا إليها خلال هذه الدراسة هي أن القانون أقر للطبيب المتهم مجموعة من الضمانات التأديبية ،وذلك لحمايته من تعسف السلطة التأديبية. - كما لاحظنا أن العقوبات التي يمكن أن يصدرها مرفق الصحة العمومي هي أشد من تلك التي تصدرها الهيئات النقابية لمهنة الطب، ما يجعل السلطة التأديبية التي تمارسها هذه الأخيرة في ردع الأطباء غير فعالة. - Abstract: - Doctors practicing at the public health establishment, when they commit a disciplinary error, are subject to disciplinary responsibility by the syndicate bodies of the medical profession, which are represented by the National Council, the regional councils, and by the public health establishment (the employing administration), And the doctor can be disciplinaryly liable even if this fault constitutes a criminal fault, and the disciplinary liability of the doctor can be established even if his error does not cause harm to others. - This study aims to shed light on the disciplinary system for practicing doctors in the public health establishment, and to highlight the feasibility of the disciplinary authority in deterring doctors. One of the most important results we reached during this study is that the law approved a set of disciplinary guarantees for the accused doctor, in order to protect him from the arbitrariness of the disciplinary authority. We also noticed that the penalties that can be issued by the public health facility are more severe than those issued by the syndicate bodies for the medical profession, which makes the disciplinary power exercised by the latter in deterring doctors ineffective. :
