الملخص

إن صغر حجم المؤسسات الصغيرة والمتوسّطة والذي كان في السابق يعيق نموها وتطورها أضحى اليوم يمثل خاصية تتمتع بها هذه المؤسسات، والتي تقوم العلاقة بينها على أساس التنافس والذي يؤدي في غالب الأحيان إلى إضعافها وربما إفلاسها لقلة مواردها، من هنا تبرز أهمية التجمعات الإقتصادية العنقودية في احتواء هذا النقص، وذلك ما جعل وضع إطار قانوني خاص بها ضرورة ملحة، حيث تؤسس هذه التجمعات لتضم هذه الفئة من المؤسسات دون المساس باستقلاليتها وكيانها المنفرد، مما يجعل الشركاء أكثر تنافسية مما لو أنجزت هذه المؤسسات المهام بمفردها، إضافة إلى مضاعفة إنتاجيتها وزيادة حصتها في السوق وذلك ما يضمن إستدامتها. The small size of small and medium enterprises, which in the past hindered their growth and development, has become today a characteristic enjoyed by these enterprises, whose relationship is based on competition, which often leads to their weakening and possibly bankruptcy due to their lack of resources. Hence the importance of cluster economic groupings in containing This deficiency, and that is what made the development of a legal framework for it an urgent necessity, as it establishes these groupings to include this category of enterprises without prejudice to their independence and their individual entity, which makes the partners more competitive than if these enterprises accomplished the tasks on their own, in addition to doubling their productivity and increasing their share in the market. This is what guarantees its sustainability.
