الملخص
الملخص: لقد شاع الزواج العرفي في المجتمع الجزائري بشكل ملحوظ، وهذا راجع لعدة أسباب، وهو زواج صحيح إذا توافرت فيه جميع الأركان والشروط، إلا أنه يفتقد التوثيق الرسمي حتى يرتب جميع الآثار القانونية، فقد نص المشرع الجزائري على مجموعة من الإجراءات لتسجيل الزواج العرفي إلا أنها لم تحقق الهدف المنشود. إذ تعددت المشاكل المطروحة أمام القضاء الجزائري والمتعلقة بإثبات النسب وتوثيق الزواج، التي تتعدى الآلاف من القضايا سنويا، لذا كان لزاما على المشرع الجزائري أن يسن عقوبات ردعية للحد من ظاهرة الزواج العرفي. Abstract: The customary marriage has spread significantly in Algerian society due to several reasons, and it is a valid marriage when meeting all the elements and conditions. However, it lacks official documentation in order to arrange all legal effects, as the Algerian legislator stipulated a set of procedures for registering the customary marriage, but they did not achieve the intended goal. Moreover, there are many problems before the Algerian judiciary related to establishing lineage and documenting marriage, which exceed thousands of cases annually. Therefore, it was necessary for the Algerian legislator to enact deterrent penalties to reduce the phenomenon of customary marriage.
