الملخص
الزواج ميثاق غليظ كما جاء في القرآن الكريم، بيد أن توثيقه ليس من المسائل المرتبطة بانعقاده أو صحته، وإنما لنفاذه في مواجهة الغير. ولكونه أقدس العقود وأخطرها لتناوله حالة الأفراد وحقوقهم لا سيما ما تعلق منها بالعرض والنسب، وما يترتب عنه من إلتزامات بين طرفيه، الزوجين، غير أن آثاره تتعداهم لتمس ما ينتج عنه من أولاد وما يرتبه من علاقات نسب ومصاهرة، بل أكثر من ذلك ينتج آثارا في مواجهة المجتمع قاطبة. لذلك فإن توثيقه مسألة في غاية الأهمية كونها تحفظ كل الحقوق وتثبت كل الإلتزمات المترتبة عنه، وبذلك تتحقق حماية للأسرة خاصة وللمجتمع عامة. Marriage is a tough covenant as stated in the Holy Qur’an. However, its documentation is not one of the issues related to its contract or validity, but rather to its enforcement in the face of others. And because it is the holiest and most dangerous of contracts, it deals with the situation of individuals and their rights, especially those related to honor and lineage, and the obligations that result from it between its two parties, the spouses. The whole community. Therefore, documenting it is a very important issue, as it preserves all rights and proves all obligations arising from it, and thus protection is achieved for the family in particular and for society in general.
