التكريس الدستوري للحق في البيئة " دراسة على ضوء التعديل الدستوري الجزائري لسنة 2020 "

الملخص
ملخص: أصبحت البيئة من أهم القضايا الدولية المعاصرة، تعاظمت مشاكلها و تداعياتها على البشر حاليا وعلى الأجيال اللاحقة . الشيء الذي جعلها الشغل الشاغل للمجتمع الدولي اليوم ، فأصبحت كل الأنظمة الدستورية الحديثة تعمل على تكريسها دستوريا من أجل تعزيزها و حمايتها . و هو ما لم تخرج عنه الجزائر ، و التي آمنت و بشكل عميق بضرورة تعزيز الحق في البيئة و حمايتها، و ذلك عن طريق الاعتراف دستوريا بحق المواطن في البيئة . هذا الاعتراف الذي مر عبر مرحلتين ، مرحلة الاعتراف الضمني غير المباشر و كان في الدساتير الجزائرية قبل التعديل الدستوري لسنة 2016 ، ثم مرحلة التكريس الدستوري و الاعتراف المباشر و الصريح في التعديلين الدستوريين لسنتي 2016 و 2020 على التوالي . الكلمات المفتاحية : التكريس الدستوري – الحق في البيئة – الاعتراف الضمني– الاعتراف الصريح . Summary : The environment has become one of the most important contemporary international issues, and its problems and implications for human beings and subsequent generations have grown. This has made it the primary concern of the international community today, and all modern constitutional systems have become constitutionally enshrined for their promotion and protection. Algeria, which has deeply believed in the need to promote and protect the right to the environment, has not departed through the constitutional recognition of a citizen's right to the environment. This recognition, which went through two stages, the indirect implicit recognition phase, was in the Algerian Constitutions prior to the Constitutional Amendment of 2016, Then the constitutional dedication and direct and explicit recognition in the Constitutional Amendments of 2016 and 2020 respectively.
