الملخص
الملخص: يتمتع المواطنون اليوم بحق تأسيس أحزاب سياسية باعتباره من أهم الحقوق السياسية للإنسان ، هذا الأخير الذي ترعاه المواثيق الدولية و الأنظمة الدستورية الديمقراطية في العالم . و قد كرس المؤسس الدستوري الجزائري هذا الحق في أغلب الدساتير الجزائرية بداية من دستور 1989 التعددي ووصولا الى آخر تعديل دستوري لسنة 2020 . و نظم المشرع الجزائري الأحزاب السياسية بموجب عدة قوانين كان آخرها القانون العضوي 12 – 04 المتعلق بالأحزاب السياسية ، هذا الأخير الذي اهتم من خلاله المشرع بتنظيم الاحزاب السياسية بشكل عام و حق تأسيسها بشكل خاص . الكلمات المفتاحية: حق تأسيس حزب سياسي في الجزائر ؛ التعديل الدستوري لسنة 2020 ؛ القانون العضوي 12 -04 ؛ التصريح بتأسيس الحزب السياسي ؛ اعتماد الحزب السياسي . Abstract: Citizens today enjoy the right to establish political parties as one of the most important political rights of man, the latter sponsored by international conventions and democratic constitutional systems in the world. The Algerian constitutional founder has enshrined this right in most of the Algerian constitutions, starting with the pluralist constitution of 1989 and ending with the last constitutional amendment of 2020. The Algerian legislator organized political parties under several laws, the last of which was the Organic Law 12-04 related to political parties, this latter which the legislator took care of organizing political parties in general and the right to establish them in particular . key words : The establishment of a political party in Algeria ; the constitutional amendment for the year 2020 ; the organic law 12-04 ; the authorization of the establishment of the political party ; the approval of the political party.
