الملخص

الملخص: تعد الرقابة على تمويل الحملة الانتخابية في النظام الانتخابي اليوم، وسيلة ذات أهمية أساسية في مجال تعزيز شفافية الانتخابات ونزاهتها، لذلك أفردها القانون العضوي المتعلق بنظام الانتخابات الجديد الصادر بموجب الامر رقم 21/01 المؤرخ في10 مارس 2021 ، بجملة من الأحكام صلب الفصل الثاني من الباب الثالث من هذا الاخير ، و قد تضمنت أهم هذه الاحكام التنصيص على استحداث لجنة مراقبة تمويل الحملة الانتخابية ، توضع لدى السلطة الوطنية المستقلة للانتخابات. لذلك ، تسعى هذه الدراسة الى التحليل المركز للنظام القانوني لهذه اللجنة لمعرفة مدى تكريسه ضمان استقلاليتها التامة عضويا ووظيفيا، في اتخاذ قراراتها بكل حياد ونزاهة و شفافية ، و أيضا ، استخلاص الملاحظات و النقائص التي تلاحظ على نظام هذه المراقبة. Abstract The control of campaign financing in today's electoral system is a lever of fundamental importance to strengthen the transparency and integrity of elections. For this reason, the Algerian Electoral Code promulgated in 2021 has devoted a series of provisions to it in chapter two of book three. Perhaps the most important of these provisions is the creation, within the independent national election authority, of a campaign finance control commission. This study aims to analyze the legal status of this commission in order to know to what extent it guarantees its total independence on the organic and functional levels in order to make decisions in all neutrality, integrity and transparency. In addition, it is appropriate to identify the remarks and shortcomings that can be noted the regime of this control.
