ماهية الوقف عند المذاهب الأربعة وأثر الخلاف فيه

الملخص
ملخص: يهدف هذا البحث-ماهية الوقف عند المذاهب الأربعة وأثر الخلاف فيه- إلى دراسة مسألة فقهيّة من مسائل الوقف خاصّة، والمعاملات الماليّة عامّة، والتي كثُر فيها الخلاف كثيرا بين فقهاء الشّريعة قديما وحديثا، حاولت من خلالها أن أتتبّع خلاف المذاهب الفقهيّة الأربعة - الحنفيّة، والمالكيّة، والشّافعية، والحنابلة - في بيان مفهوم الوقف، وأثره على مسائله وأحكامه. إشكاليّته تمحورت حول ثلاث نقاط رئيسة: مفهوم الوقف عند المذاهب الأربعة؟ لماذا اختلف الفقهاء في تعريف الوقف؟ وماهي ثمرة هذا الخلاف؟ الهدف من ذلك كلّه نشر ثقافة الوقف في أوساط المجتمع بجميع أطيافه. صِبغة الموضوع الفقهيّة اقتضت منّي أن أتّبع المنهج الوصفيّ، والمنهج الاستقرائيّ، والمنهج المقارن، والمنهج الاستدلاليّ الاستنباطيّ . وفي الأخير توصّلت إلى أنّ العلماء اختلفوا في ماهية الوقف لعدّة أسباب، أهمّها: قلّة النّصوص الشّرعيّة الواردة في بابه، قياسه على المعاملات الماليّة الأخرى، كالبيع والهبة والوصيّة وغيرها، وُقُوعه بين نظريّتي التّبرّع والإسقاط وما ترتّب عنهما. الكلمات المفتاحيّة: )المعاملات الماليّة، التّبرّع، الوقف، الخِلاف، المذاهب الأربعة( Résumé: Cette recherche intitulée- Le WAQF chez les quatre écoles doctrinales définition et effet de différent- vise à étudier une question doctrinale appartenant au WAQF en particulier et aux transactions financières en général, où beaucoup de désaccords entre les juristes de la Charia sont apparus dans le passé et le présent. Dans cette étude j’ai tenté de pister le différent des quatre Juristes - Hanafi, Maliki, Al-Shafiet, Hanbali - dans leurs définitions du WAQF et les conséquences sur ses sujets et dispositions. La problématique était focalisée sur les trois points principaux : la définition du WAQF chez les quatre écoles doctrinales ? Pourquoi ce différent ? quel est le fruit de ce différent ? le but de tout cela est la vulgarisation et l’enrichissement de la culture du WAQF au sein de la société. La nature doctrinale du sujet a exigé l’adoption des approches : descriptive, inductrice, comparative et déductive. J’ai finalement conclu que les juristes différaient sur ce qu’était le WAQF pour un certain nombre de raisons dont les plus importantes sont : Le peu de textes y afférent, sa projection sur les autres transactions financières tel que la vente, le don, le testament et bien d’autre, aussi, en se retrouvant cerné entré la théorie de donation et de la projection et ce qui en découle. Abstract: The research aimed -Definition and discord of the WAQF by the four doctrinal schools- at studying a doctrinal issue linked to the WQF in particular as well as to the financial transactions in general. We notice differences in opinions of the Shariah’s jurists which have been arisen now and then in defining the WQF and the consequences of its subjects and provisions. The main issue is on the four important points: The definition of the WAQF by the four doctrinal schools, why is there a discord? What are the results of these discords? The purpose of what was cited above is to popularise and enhance the culture of the WAQf within the society. The doctrinal subject matter required the adoption of the descriptive, inductive, comparative as well as the deductive approaches. To put it in a nutshell, the legal experts differed from on what WAQF is for many reasons and the most important ones are: Poor related texts, its projection on the financial transactions/deals such as sales, Donation, The will … etc. According to these, it is limited by the flowing of the donation and the projection theories.
