تصرف الحاكم مع وباء كورونا وتطبيقاته المعاصرة

الملخص
يُعد وباء كورونا من النوازل المستجدة التي أثرت على مختلف المجلات السياسية والاقتصادية والاجتماعية والعلمية، فكان لابد من تدخل الحاكم وتصرفه إزاءها للحد من انتشار الوباء وخطره، وهذا التصرف ليس ببعيد عن الوجهة الفقهية والسياسة الشرعية التي ينبغي للحاكم أن يسلك سبيلها ويجري مجراها، فإن إشكالية انعدام الحاكم المجتهد في ظل الدولة الإسلامية المعاصرة، أوجب تدخل العلماء وأهل الإفتاء من خلال الهيئات الشرعية والمجامع الفقهية وغيرها للنظر في هذه النازلة المستعصية، فكان المقصد النظر في هذا التصرف وبيان مفهومه وقواعده. ولقد تبين بعد توكيل الأمر للمتخصصين وأهل الخبرة من لجان الإفتاء والمجامع الفقهية والاعتماد على الشورى مع اللجان الطبية والمنظمات الصحية، أن تصرف الحاكم بُني على قواعد ثلاثة أساسية وهي أن: "تصرف الإمام على الرعية منوط بالمصلحة" و "تقييد الحاكم للمباح" وكذا قاعدة أن: "تصرف الإمام أو نائبه يرفع الخلاف في المجتهدات" شريطة أن يكون التصرف اجتهاديا بعد نظر ومشورة، وأن يقع في مجاله الذي اشترطه الفقهاء. The Corona epidemic is one of the emerging calamities that affected the various political, economic, social and scientific magazines, so the ruler had to intervene and act towards it to limit the spread and danger of the epidemic, and this behavior is not far from the jurisprudential direction and the legal policy, which the ruler should follow and follow its course, the problem is The lack of a diligent ruler in the light of the contemporary Islamic state, necessitated the intervention of scholars and the people of fatwas through the Sharia bodies and the Fiqh Councils and others to look into this intractable calamity, so the intention was to consider this behavior and clarify its concept and rules. After delegating the matter to specialists and experts from fatwa committees and jurisprudence councils, and relying on shura with medical committees and health organizations, it became clear that the ruler's behavior was based on three basic rules: “The imam’s behavior over the parish depends on interest,” “restricting the ruler to permissible,” as well as the rule that : “The behavior of the imam or his deputy raises the disagreement in the mujtahidat” provided that the behavior is an opinion and advisory opinion, and falls within the scope of which the jurists stipulated it.
