الملخص
الملخص: يبدوا لأول وهلة أن المواجهة الالكترونية لجرائم خطاب الكراهية والتمييز؛ ما هي سوى طارئ إجرائي عابر، يدخل ضمن إطار المواكبة التشريعية للتطورات الحاصلة، من منطلق نظرة حداثية عامة لدى المشرع. وما إصباغ المشرع لـ 07 من بين 09 مواد إجرائية واردة بالقانون رقم: 20-05، بالصبغة الالكترونية؛ إلا توجه عام لا يدفع للبحث في الأسباب والأهداف والنتائج ذات الصلة. إلا أنه تبين من خلال دراسة الحال، أن المواجهة الالكترونية لجرائم خطاب الكراهية والتمييز؛ تعد بمثابة الحتمية التي تدفع لها طبيعة هذه الجرائم، سيما وأن أخطرها وقعا على المجتمع بكل مكوناته ومؤسساته؛ هي المتصلة بالوسط الالكتروني، الذي يكون مسرحها ووسيلة إثباتها في الآن ذاته. Abstract: It appears for the first time that the cyber standoff against hate speech and discrimination crimes is only a transient procedural emergency, which falls within the framework of legislative accompaniment of social changes. The legislator stipulated, in Articles 07 to 09 of Law No. 20-05, the cyber nature, which is a general tendency that pushes the research into the causes, objectives and results that are in line with this matter. Through this study, cyber standoff against hate speech and discrimination crimes is an inevitable, so the impact on society with all its components and institutions are those related to the cyber environment, which is the place of their commission and the means of proving them at the same time.
