الملخص

وضع المشرع في دولتي الجزائر و الإمارات العربية المتحدة نظاما قانونيا خاصا لتجريم الأفعال الموصوفة بالتمييز و خطاب الكراهية و حدد فيه العقوبات المقررة لها بحسب الحالة، كما استحدث مجموعة من الآليات القانونية للوقاية منها و مكافحتها بشكل متفاوت بين الدولتين. و نتيجة لصعوبة تحديد النطاق القانوني لهذا الموضوع و تداخله مع حرية الرأي و التعبير و حداثة التجربة بالنسبة للدولتين و تعدد صور هذا الموضوع و الوسائل المستعملة في ذلك، بداية بالوسائل التقليدية وصولا إلى الفضاء الرقمي أصبح التساؤل يثور حول مدى كفاية القواعد القانونية لمكافحة هذه الأفعال المجرمة و الوقاية منها. The legislator in the two countries of Algeria and the United Arab Emirates established a special legal system to criminalize acts described as discrimination and hate speech, and also defined the penalties prescribed for them according to the case, and also introduced a set of legal mechanisms to prevent and combat them in a different way between the two countries. As a result of the difficulty in defining the legal scope of this subject and its overlap with freedom of opinion and expression, the newness of the experience for the two countries, and the multiplicity of forms of this topic and the methods used in this, beginning with traditional means up to the digital space, a question arises about the adequacy of the legal rules to combat these criminal acts and Prevention.
