الملخص
ملخص: يبدوا لأول وهلة أن الوضع تحت المراقبة الالكترونية؛ ما هو سوى إجراء عابر كباقي الإجراءات التي يواجه بها المتهم والمدان. وما خصوصيته إلا بسيطة من منطلق الكتروني حديث، لا يصبغ على الجانب الإجرائي أي دافع للقول بكونه نظام جامع، يتوجب التأسيس له في شكل أحكام عامة موحدة. إلا أنه بدراسة الحال تبين أن الوضع تحت المراقبة الالكترونية؛ هو نظام إجرائي يتوجب التأسيس له بمدخل عام، يتضمن الأحكام العامة الفقهية والنصية، التي تمهد للدراسة الإجرائية الدقيقة، من شروط وأشخاص وغيرها. كلمات مفتاحية:مراقبة الكترونية، وضع، متهم ومدان، إجراء بديل،مدخل لنظام جامع. Abstract: "The placement under electronic surveillance system" is a procedure like the rest of the procedures that both the accused and the convicted can face. However, from a modern electronic standpoint, the procedural side does not give any motive to say that it is a comprehensive system, which must be established in the form of unified general provisions. In this study, we find that the placement under electronic surveillance system is a procedural system that must be established with a general entrance, which includes the general legal and lextual provisions that pave the way for accurate procedural study of conditions, people and others.
