الملخص

إن الخاصية التي تتميز بها سلطات الضبط في المجال المالي والمصرفي وتجعلها مختلفة عن باقي الهيئات التقليدية الموجودة في الدولة، تكمن في عنصر الاستقلالية، ما يجعلها بعيدة عن أية رقابة إدارية أو وصائية ولا تخضع لمبدأ التدرج السلمي، إلا أن هذه السلطات أثارت بدورها عدة تساؤلات حول مدى استقلاليتها عن السلطة التنفيذية، لذلك سنحاول في هذا البحث تسليط الضوء على مظاهر الاستقلالية ومظاهر التبعية لسلطات الضبط المصرفي تجاه السلطة التنفيذية. The feature that characterizes the regulatory authorities in the financial and banking field and makes them different from the rest of the traditional bodies in the state lies in the element of independence , which makes them far from any administrative or custodial oversight and not subject to the principle of the gradation scale, However, these authorities, raised several questions about the extent of its independence from the executive authority, so we wille try in this research to shed light on the manifestations of independence and of dependence of the banking control authorities towards the executive authority.
