الرقابة الإدارية على طرفي عقد تفويض المرفق العمومي البلدي

الملخص
تهدف عقود تفويض المرفق العمومي البلدي التي يعهد من خلالها شخص من أشخاص القانون العام إلى شخص من أشخاص القانون العام أو الخاص إمّا تسيير مرفق عمومي معين أو تسييره وصيانته أو حتّى إنشاءه، إلى تحقيق مجموعة من الأهداف الرامية إلى توفير الأغلفة المالية اللازمة لتحقيق المرفق، تخفيف عبئ العمل على البلديات، تحقيق نوعية أفضل من الخدمات واستقطاب التكنولوجيات. لكن بعض الممارسات التي قد تحول دون تحقيق هذه الأهداف تضطرنا إلى تحديد إطار رقابي فعّال، فالرقابة على هذه العقود يمكن أن تكون إدارية أو قضائية، وهذا البحث يحمل في ثناياه تفصيلا للرقابة الإدارية، فقسم إلى نقطتين، خصصت الأولى للرقابة على السلطة المفوضة، فيما تضمنت الثانية الرقابة على المفوض له. The municipal public service delegations, that makes a public law individual entrust another individual to manage a specific public utility or maintain it or build it up, aims at achieving a collection of goals to provid the necessary financial covers to realize the public service, ease the hard work, realize a better quality of services and attract technologies. However some practices that prevent realizing these goals oblige us to specify an effective supervisory framework. The control of these contracts can be administrative or judicial, this research then carries in its folds details of administrative control, is divided into two points, the first is dedicated to the control over the delegated authority, the second is dedicated to the control over the authorized side.
