The Extradition System As A Mechanism To Combat Transnational Organized Crime, A Descriptive Analytical Study

Abstract
:Abstract: The extradition system is one of the mechanisms for international judicial cooperation in the fight against transnational organized crime, through a State extraditing a person to another State, based on an official request, to be tried or to execute a judgment that has been lifted for committing a crime that falls within the scope of transnational crimes.The extradition system draws its strength from the original and complementary sources which help the judge not to fall into the crime of denial of justice. This system requires a set of conditions, including those relating to the person subject to extradition, and those relating to the reason for the extradition. This study relied on the descriptive analytical approach to try to understand this mechanism of international judicial cooperation, which can only succeed with a set of measures, including activating the role of international courts, the strengthening of cooperation between the parties of the international community in the field of information exchange and the use of modern technologies for extradition purposes, and adopting flexible means and systems which reconcile new developments in the world of organized crime, and protection of human rights, on the other. In the following sections, we will try to approach the concept of extradition system by examining the definition of this system, its legal basis its conditions through this research paper. . Résumé: Le système d'extradition est l'un des mécanismes de coopération judiciaire internationale dans la lutte contre la criminalité transnationale organisée, par le biais d'un État extradant une personne vers un autre État, sur la base d'une demande officielle, pour être jugée ou pour exécuter un jugement qui a été levé pour avoir commis un crime qui entre dans le champ des crimes transnationaux. Le système d'extradition puise sa force dans les sources originales et complémentaires qui aident le juge à ne pas tomber dans le délit de déni de justice. Ce système requiert un ensemble de conditions, dont celles relatives à la personne objet de l'extradition, et celles relatives au motif de l'extradition. Cette étude s'est appuyée sur l'approche analytique descriptive pour tenter d'appréhender ce mécanisme de coopération judiciaire internationale, qui ne peut aboutir qu'avec un ensemble de mesures, y compris la revitalisation du rôle des tribunaux internationaux, le renforcement de la coopération entre les parties de la communauté internationale dans le domaine de l'échange d'informations et de l'utilisation des technologies modernes à des fins d'extradition, et d'adopter des moyens et des systèmes flexibles qui concilient les nouvelles évolutions du monde de la criminalité organisée et la protection des droits de l'homme, d'autre part. Dans ce qui suit, nous tenterons d'aborder la notion de système d'extradition en examinant la définition de ce système, son fondement juridique et ses conditions à travers ce mémoire de recherche.
