الملخص
ملخص شكلت الرقابة الادارية والمعبر عنها عادة في مجال الفقه القانوني الاداري برقابة الوصاية، لازمة و أساس لقيام وبناء التنظيم الاداري في الدولة. وهي بهذه الصفة تطرح اشكالية في مجال تسيير وتدبير الشأن العام بحيث ينظر لها من ناحية تجسيد سلطة الدولة على انها اَلية ورابطة تكرس عدم الاستقلال التام للجماعات الاقليمية حتى مع تبني نظام اللامركزية الادارية، في حين يرى فيها دعاة مبدأ حرية الادارة للجماعات الاقليمية او المحلية كابحاً ومعرقلاً احياناً لتلك الحرية. وهي المعادلة التي حاول المقال معالجتها ان من زاوية تشخيص اسباب الظاهرة او من زاوية البحث عن سبل وامكانات التوفيق بين عناصرها خدمة للمصلحة العامة وتحقيقاً للحكم الراشد وهو غاية وفلسفة كل تنظيم اداري. الكلمات المفتاحية: رقابة الوصاية، هيئة الوالي، النظام الانتخابي، الاصلاح الاداري، الجماعات الاقليمية. Abstracts : Administrative control, which is usually expressed in the field of administrative jurisprudence with guardianship control, was a necessary and basis for establishing and building the administrative organization in the state. In this capacity, it poses a problem in the field of management and management of public affairs, so that it is seen in terms of embodying the state’s authority as a mechanism and association that establishes the lack of complete independence of the regional groups even with the adoption of the administrative decentralization system, while advocates of the principle of freedom of administration for regional or local groups see it as a brake and an obstacle Sometimes that freedom. It is the equation that the article tried to address, from the point of view of diagnosing the causes of the phenomenon, or from the point of view of searching for ways and possibilities to reconcile its elements in the service of the public interest and the achievement of good governance, which is the goal and philosophy of every administrative organization.
