الملخص

الملخص: تبنى المؤسس الدستوري في الجزائر مبدأ وحدة إقليم الدولة منذ الإستقلال واعتمد على النظام الإداري اللامركزي كأسلوب لإدارة هذا الإقليم، فقسمت الدولة لوحدات إدارية هي الجماعات المحلية ممثلة في البلدية والولاية، ومنح لهما الاعتراف بالإستقلال الإداري والذمة المالية المستقلة، ورغم منحهما إختصاصات إدارية إلا أن المشرع فرض عليهما رقابة وصائية مشددة، مما أخل بفكرة اللامركزية الادارية والمغزى منها، وقلص من استقلالية الجماعات المحلية وجعلها في تبعية كبيرة للسلطة المركزية. Abstract: The constitutional founder in Algeria adopted the principle of the unity of the territory of the State since independence and relied on the decentralized administrative system as a method of managing this region. The state was divided into administrative units, which are the local groups represented in the municipality and the wilaya, and it granted them recognition of administrative independence and independent financial responsibility, and despite their granting of administrative powers, the legislator imposed They have strict supervisory control, which violates the idea of administrative decentralization and breaks its meaning, and reduces the independence of local groups and makes them highly dependent on central authority.
