آليات الحماية القانونية للثروة الغابية من الحرائق في الجزائر

الملخص
ملخص يستدعي الاهتمام بالنظام البيئي الالتفات لمختلف العناصر البيئية المرتبطة به، وتعد الثروة الغابية من أهم هذه العناصر، مما يجعلها جديرة بالحماية القانونية نظرا لأهميتها على الصعيد الاجتماعي والاقتصادي والبيئي، لكنها كثيرا ما تتعرض للاعتداء بكافة صوره بدء من إتلاف وتخريب الغابات، إلى إضرام النار فيها، وهو الأمر الذي تعاني منه مختلف دول العالم، بما فيها الجزائر التي عرفت العديد من الحرائق الكبرى، خصوصا في السنوات الأخيرة، والتي خلفت العديد من الأضرار البشرية والمادية والبيئية بصفة عامة. وتنصب الحماية القانونية للثروة الغابية في الجزائر على آليات قانونية وقائية وأخرى علاجية ردعية لمكافحة هذه الظاهرة الخطيرة، وذلك ضمن قواعد قانونية تكرس الضبط التشريعي والضبط الإداري والضبط القضائي في آن واحد. أما عن فعالية مختلف هذه الآليات في تحقيق الهدف الذي وجدت من أجله وهو حماية الثروة الغابية من الحرائق فقد تبين من خلال هذه الدراسة تفاوت في درجات النجاعة من آلية لأخرى، مما يستوجب إدخال بعض التعديلات على القانون المتضمن النظام العام للغابات والتنظيمات المتصلة به. Abstract: Attention to the ecosystem requires attention to the various environmental elements associated with it and forest wealth is one of the most important elements, making it worthy of legal protection because of its social, economic and environmental importance, But they are often attacked in all its forms, starting from the destruction and vandalism of forests, To set them on fire, which is what various countries of the world are experiencing, including Algeria, which has experienced many major fires, especially in recent years, human, material and environmental damage in general. The legal protection of Algeria's forest wealth focuses on preventive and deterrent legal mechanisms to combat this serious phenomenon, within the framework of legal norms that establish both legislative and administrative discipline and judicial control. As to the effectiveness of the various mechanisms in achieving the objective for which they were found to protect forest wealth from fire, this study showed varying degrees of efficiency from one mechanism to another, necessitating some amendments to the law on public forest order and related regulations.
