الحماية الوقائية للأملاك الغابية من الحرائق في التشريع الجزائري

الملخص
تهدف هذه الدراسة إلى إبراز أهم التدابير الوقائية التي كرسها المشرع الجزائري ضمن المنظومة القانونية للغابات، لحماية الملكية الغابية من الحرائق، ودراسة مدى فاعليتها ونجاعتها في التصدي لهذه الكارثة التي استفحلت كثيرا في السنوات الأخيرة من هذه الألفية، وتسببت بمخاطر عديدة على المجتمع والبيئة. وخلصت الدراسة إلى أن الجزائر قد أبدت في الآونة الأخيرة اهتماما كبيرا بحماية الملكية الغابية، بتفعيل آليات وقائية استباقية لتجنب الحرائق، فرغم كل الجهود التي بذلتها، إلا أن الواقع مازال يكشف عن ضعف المنظومة القانونية للغابات في مجابهة الحرائق، التي مازالت تلتهم آلاف الهكتارات من الثروة الغابية. Abstract : This study aims to highlight the most important preventive measures devoted by the Algerian legislator within the legal system of forests, to protect forest property from fires, and to study the extent of their effectiveness and efficacy in addressing this catastrophe that has worsened greatly in the last years of this millennium, And caused many dangers to society and the environment. The study concluded that Algeria has recently shown great interest in protecting forest property, by activating proactive and protective mechanisms to avoid fires, Despite all the efforts it has made, the reality still reveals the weakness of the legal system of forests in the face of fires, which are still devouring thousands of hectares of forest wealth.
