عقد الاستغلال كآلية لاستثمار العقارات الوقفية

الملخص
لقد أحدث المشرع الجزائري آلية جديدة لاستغلال العقارات الوقفية وهو عقد الاستغلال، هذا العقد الذي تمنح بموجبه إدارة الأوقاف العقار الوقفي إلى مستثمر شخص طبيعي أو معنوي عام أو خاص، قصد استغلاله وتنميته وفق دفتر شروط يحدد حقوق والتزامات الطرفين، ويتم منح العقار الوقفي إلى المستثمر عن طريق المزايدة كأصل عام وذلك في إطار مبادئ المنافسة وتثمينا للعقار محل الاستغلال، غير أنه يمكن في حالات استثنائية منح العقار عن طريق التراضي. the Algerian legislator has created a new mechanism for the exploitation of wakfs real estate, which is the operating contract, this contract by virtue of which the administration of the endowment concedes the endowment real estate to an investor, natural or legal person, public or private, in order to operate and develop it according to specifications that define the rights and obligations of both parties, and the wakfs property is granted to the investor by public auction within the framework of the principles of competition and valuation of the exploited asset, but in exceptional cases it is possible to grant ownership by mutual consent.
