تسوية البنايات غير المطابقة لرخصة البناء المسلّمة وفقاً للمرسوم التنفيذي رقم 22-55

الملخص
تعتبر عملية تحقيق مطابقة البنايات من المهام التي لا تزال تؤرّق السّلطات العمومية في الجزائر، فمنذ صدور قانون مطابقة البنايات وإتمام إنجازها سنة 2008، لم تتوقّف الآلة القانونية عن إنتاج النصوص، في محاولة للبحث عن آليات تطبيق القانون وإزالة العقبات التي تواجه الإدارة خلال عملية تسوية البنايات، وقد كان المرسوم التنفيذي رقم 22-55 من أحدث ما أنتجته هذه الآلة، حيث ينصرف مضمونه إلى تحديد شروط تسوية البنايات غير المطابقة لرخصة البناء المسلّمة، والذي صدر تطبيقاً لنص المادة 113 من قانون المالية لسنة 2017 سنحاول في هذه الورقة البحثية تسليط الضوء على أحكام هذا المرسوم، ودراستها دراسة وصفية، تحليلية ونقدية، قصد الإحاطة بمختلف الجوانب القانونية التي تضمّنها، والخروج بنقاطه الإيجابية والسلبية، للكشف عمّا يُضيفه هذا المرسوم إلى البناء القانوني المتعلّق بحلّ المشاكل العمرانية النّاتجة عن البناء المخالف للتنظيمات القانونية. The process of building matching is one of the tasks that still haunts the public authorities in Algeria, and since the issuance of a law Matching buildings and completing their completion in a year 2008; The legal machine has not stopped producing texts, in an attempt to search for mechanisms for applying the law and removing obstacles facing the administration during the process of settling constructions, and the Executive Decree No 22/55 One of the latest products produced by this machine, its content determines the terms of settlement of constructions non- compliant with the delivered building permit, this decree was issued in accordance with the text of the article 113 From the finance law of the year 2017. In this research paper, we will try to shed light on the provisions of this decree, and studying them descriptively, analytically and critically, in order to take note of the various legal aspects contained in it, and come out with its positive and negative points, to reveal what this decree adds to the legal system related to solving urban problems resulting from construction contrary to legal regulations.
