مبدأ التكامل في ظل القضاء الجنائي المؤقت ( محكمتي نورمبورغ وطوكيو نموذجا)

الملخص
عقب انتهاء الحرب العالمية الثانية ،أنشئت محكمة نورمبورغ لمحاكمة مجرمي الحرب من دول المحور،ونصت هذه المحكمة في المادة العاشرة من نظامها الأساسي بأن الاختصاص ينعقد في بادئ الأمر إلى المحاكم الوطنية ثم يكملها في الاختصاص المحاكم العسكرية، ويليها محاكم الاحتلال، فنص هذه المادة يعتبر تصريحا بالتكامل بين المحاكم بأنواعها الثلاثة، بعد ذلك تم إنشاء محكمة طوكيو بناء على إعلان عسكري، لمحاكمة مجرمي الحرب اليابانيين،ولقد عرفت هذه المحكمة كذلك كسابقتها في نورمبورغ تطبيقا لمبدأ الإختصاص التكميلي في نص المادة السادسة من نظامها الأساسي والتي جعلت الاختصاص الأصيل للقضاء الوطني، وذلك بتقديم ولايتها على المحاكم الجزائية الدولية، تم أضافت المادة بجعل اختصاص القضاء الجنائي الدولي في مرحلة تالية، وذلك بموجب الموافقة الصريحة من الدول الأطراف في النزاع، والذين يكونوا قد صادقوا على هذه الاتفاقية. Abstract: After the end of the Second World War, the Nuremberg Court was established to try war criminals from the Axis countries, and this court stipulated in Article X of its statute that jurisdiction is held in the first instance to the national courts and then completed in the jurisdiction of the military courts, followed by the occupation courts, so the text of this article is considered a permit By the complementarity of the three types of courts, then the Tokyo Court was established based on a military declaration, to try Japanese war criminals, and this court was also known as its predecessor in Nuremberg, in application of the principle of complementary jurisdiction in the text of Article Six of its statute, which made the brother Sas National authentic judiciary, providing its jurisdiction over the international criminal courts, has been added article by making the jurisdiction of the international criminal justice at a later stage, under the explicit consent of the States parties to the conflict, and who they have ratified this Convention. .
