الملخص

ملخص: تسعى الدول جاهدة الى جذب لاستثمارات الأجنبية بغية تطوير اقتصادها الوطني ولا يتسنى لها ذلك الا من خلال توفيرها لجملة من الضمانات القانونية التي تحمي المستثمرين الأجانب والجزائر كغيرها من الدول سعت لتكريس مجموعة من الضمانات هدفها حماية وتشجيع المستثمرين الأجانب وباعتبارها صاحبة السيادة يواجه المستثمر الأجنبي عدة مخاوف وإشكالات عند ممارسة نشاطه الاستثماري على إقليمها باعتبار كل منهما ينتمي لنظام قانوني مغاير عن الآخر هده الإشكالات غالبا ما تنتهي بمنازعات بينه وبين الدولة الجزائرية لان المنازعات الاستثمارية لها طابع خاص يميزها عن باقي غيرها من المنازعات الأخرى ولتسوية هده المنازعات عمدت الجزائر الى تكريس مجموعة من الآليات القضائية لحل النزاعات بالنص عليها في تشريعها الداخلي ومن خلال الاتفاقيات الدولية تمثلت في ضمانة اللجوء للقضاء الوطني الجزائري والى التحكيم التجاري الدولي . كلمات مفتاحية: المستثمر الأجنبي ، الآليات القضائية , المنازعات الاستثمارية ، التحكيم التجاري الدولي . Abstract: Countries strive to attract foreign investment in order to devlop their national economy , and they can only do so by providing a set of legal guarantees that protect foreign investors Algeria , like other countries , has endeavoredto devote a set of guarantees aimed protecting and encouraging foreign investors as a sovereign the foreign investor faces several concerns and problems when practicing his investment activity on its territory , as each of them belongs to a legal system different from the other , these problems often end with dispuites between him and the Algerian state because dispuites investment has a special nature that distinguishes it from other dispuites to settle these disputes , Algeria has devoted a set of judicial mechanisms to resolve disputes by stipulating it in its intemallegislation and through international agreements represented in resorting to the Algerian national judiciary and to international commercial arbitration Keywords: foreign investor , judicial mechanisms , investment dispuites, internatonal commercial arbitration .
