الملخص
الملخص تقوم دولة القانون اليوم على مبدأ المشروعية وذلك بخضوع الكل لسلطة القانون، حكاماً ومحكومين. إلا أنه وبالرجوع لما تمتاز به الإدارة من امتيازات السلطة العامة نجد أن تجسيد مبدأ المشروعية يكاد يكون نسبياً. فالإدارة غالباً ما تتعسف في استعمال سلطتها تجاه الأفراد والأشخاصوعليه إذا أخلت الإدارة بالتزاماتها تجاه أي شخص فما عليه إلا التوجه للقضاء الإداري الذي سيوجه أوامر للإدارة مطالباً أياها بتنفيذ ما التزمت به. وإذا تعنتت الإدارة في عدم تنفيذ ما التزمت به رغم صدور حكم أو قرار قضائي يأمرها بتنفيذ التزاماتها، فقد منح القانون سلطة جواز للقاضي أن يفرض غرامة تهديدية على الادارة لفترة زمنية محددة من أجل إكراهها على التنفيذ. فالغرامة التهديدية هي وسيلة ضغط وإكراه الادارة على تنفيذ أحكام القضاء الصادرة ضدها. Title of the Article: Commenting on a Judicial Decision, the Extent of the Jurisdiction of the Relief Judge to pass a Threatening Fine in Administrative Disputes. Abstract Nowadays, the state of law is based on the principle of legality by subjecting all to the authority of law, rulers and ruled. However, by reference to the prerogatives of public authority that the administration possesses, the principle of legality is almost relatively embodied. The Administration often abused its authority towards individuals and persons. Accordingly, if the administration breaches its obligations towards any person, this latter has to seek administrative judiciary, which will direct orders to the administration, forcing it to implement what it has committed to. If, despite a judgement or a judicial decision ordering it to fulfil its obligations, theadministration isstill intransigent, the law has given the power to the judge to impose a threatening fine on the administration for a specified period of time in order to force it to implement. A threatening fine is a means of pressure and coercion to force the administration to compel to the court rulings issued against it.
