الملخص: كرّست تشريعات الاستهلاك الالتزام بالسلامة، ومنحته خصوصية ميزته عن غيره من الالتزامات الأخرى كالالتزام بالإعلام والالتزام بالمطابقة...فاكتسى معاملة تفضيلية خاصة، كونه مرتبط بالسلامة الجسدية للشخص، ولا يقتصر بالتحديد على صفة المستهلك وفقط، بل يمتد ليشمل كل شخص يحمل صفة المضرور، حتى و إن كان خارج الإطار التعاقدي، ومن جهة أخرى اتسمت هذه التشريعات بالطابع الوقائي والجماعي بخصوص الالتزام بالسلامة، تعددت فيها الجزاءات حتى مست الشقين المدني والجزائي.
