الملخص
الملخص: يواجه المصطلح القانوني العديد من الإشكالات القانونية عند التعرض إلى ترجمته من لغة إلى أخرى، لصعوبات ترتبط بضرورة التقيد بخصوصية المصطلح القانوني نظرا للطابع التقني للغته فضلا عن تعبيره على نظام قانوني معين، ويعرف إشكال خاص بالنسبة لترجمة المصطلحات المستمدة من الشريعة الإسلامية، والتي كثيرا مالا تجد مقابلا لها في اللغة الاجنبية من جهة، وانتشار الترجمة الالية وما تمخض عنها من ظهور مصطلحات مستجدة من جهة أخرى، حيث اهتمت العديد من المؤسسات الدولية بتوحيد المصطلح القانوني منها القسم المصطلحي بالأمم، ولجنة الأمم المتحدة للقانون التجاري الدولي، فضلا عن اعتماد قوانين نموذجية. Summary: The legal term faces many legal problems when facing its translation from one language to another, to difficulties related to the necessity to adhere to the specificity of the legal term due to the technical nature of its language as well as its expression on a specific legal system, and it defines a special problem with regard to the translation of terms derived from Islamic law, which is often It cannot find an equivalent in the foreign language on the one hand, and the spread of machine translation and the resulting terminology on the other hand. Many international institutions have been interested in standardizing the legal term, including the terminological division of nations, the United Nations Commission on International Trade Law, as well as adopting model laws
