الملخص
تعد النصوص والمصطلحات القانونية في أي نص قانوني أو مستند له علاقة بالقانون ذات خصوصية وأهمية في قطاع القضاء والعدالة ، يمكن أن يعني هذا جميع أنواع المستندات المطلوبة من قبل أنظمة الدولة المدنية والجنائية. إن النصوص القانونية بمختلف أنواعها والتي تأتي كمدونة قانونية صاغها المشرعون و فقهاء القانون ، تستند في جزء منها على النصوص القانونية المترجمة من القانون الأجنبي ، وجزء وضع من قبل المشرعين في الدول العربية عموما والجزائر خصوصا. لكن الكثير من هذه النصوص عانت منذ البداية من أخطاء تعود لسوء الترجمة تارة ، ومن قصور اللغة عند واضعي المصطلحات القانونية من جهة أخرى . ومن هنا تأتي إشكالية موضوعنا: ما هي أهم المشاكل التي تواجه المترجم القانوني عند ترجمته للمصطلحات القانونية ؟ وماهي المشاكل التي ساهمت في تلك الأخطاء الناجمة عن سوء الترجمة أو القصور اللغوي في وضع المصطلحات القانونية ؟ وقد حاولت في هذا البحث من منطلق تخصصي في علم الدلالة واللسانيات أن أجيب عن هذه التساؤلات ، مستعملا المنهج التاريخي والوصفي والتحليلي في ذلك. Legal texts and terms in any legal text or document related to the law are of particularity and importance in the judicial and justice sector, this can mean all kinds of documents required by the civil and criminal systems of the state. The reference in all of this is the legal texts of all kinds, which come as a legal code drafted by legislators and legal jurists, based in part on legal texts translated from foreign law, and partly drawn up by legislators in Arab countries in general and Algeria in particular. But many of these texts suffered from the beginning from errors due to mistranslation at times, and from the lack of language on the part of the authors of legal terminology on the other hand. Hence our problem: What are the most important problems facing the legal translator when translating legal terms? What are the problems that contributed to those errors caused by mistranslation or linguistic shortcomings in the development of legal terminology? In this research, I have tried from the standpoint of my specialization in semantics and linguistics to answer these questions, using the historical, descriptive and analytical method in that
