الملخص

ملخص: تتعدد أشكال وأنماط الفساد الذي شهد انتشارا واسعا في العالم خاصة بمنطقة المغرب العربي وفي هذا السياق تطرح العديد من التساؤلات حول أسباب انتشار هذه الظاهرة في دول المغرب العربي، لذا تناول هذا البحث تقييم دور آليات مكافحة الفساد في الدول المغاربية لكل من الجزائر، وتونس والمملكة المغربية. وعليه تهدف هذه الدراسة إلى تسليط الضوء على الإستراتيجية المتبعة من قبل الدول المغاربية لمواجهة الفساد على ضوء النصوص القانونية والتأكد من مدى نجاعة هذه الوسائل في مواجهة أو مكافحة جرائم الفساد من خلال تقييم السياسة الجنائية في مجال مكافحة الفساد وأفاق تفعيلها. Abstract: There are many forms and patterns of corruption that have spread widely in the world, especially in the Arab Maghreb region, and in this context, many questions arise about the reasons for the spread of this phenomenon in the countries of the Maghreb, so this research dealt with an evaluation of the role of anti-corruption mechanisms in the Maghreb countries of Algeria, Tunisia and the Kingdom of Morocco. Therefore, this study aims to shed light on the strategy followed by the Maghreb countries to confront corruption in the light of legal texts and to ascertain the extent of the effectiveness of these means in facing or combating corruption crimes by assessing the criminal policy in the field of fighting corruption and the prospects for its activation. Résumé: Il existe de nombreuses formes et schémas de corruption qui se sont largement répandus dans le monde, en particulier dans la région du Maghreb arabe, et dans ce contexte, de nombreuses questions se posent quant aux raisons de la propagation de ce phénomène dans les pays du Maghreb. Cette recherche a donc porté sur une évaluation du rôle des mécanismes de lutte contre la corruption dans les pays du Maghreb en Algérie, en Tunisie et au Royaume du Maroc.. Par conséquent, cette étude vise à faire la lumière sur la stratégie suivie par les pays du Maghreb pour lutter contre la corruption à la lumière des textes légaux et pour déterminer l'étendue de l'efficacité de ces moyens pour faire face ou combattre les délits de corruption en évaluant la politique pénale dans le domaine de la lutte contre la corruption et les perspectives de son activation.
