الحماية القانونية للصحة العامة من فيروس كورونا (كوفيد- 19)

الملخص
ترتبط الحماية القانونية بوعي متخذي القرار بأهمية إدارة جائحة كورونا بآلية ملائمة وفعالة تتعلق أساسا بالضبط الإداري لتأخذ شكلا من أشكال المقاومة، حيث تفرض وبصورة ملحة الطبيعة الخاصة للأزمة الصحية وجود تنسيق بين هيئات الضبط الإداري المختلفة للنهوض بالقطاع الصحي الذي يعمل من أجل احتواء هذه الأزمة ومعالجتها بطريقة فعالة. مما يساهم في خلق توازن يعد ضرورة لازمة لاستقرار الصحة العامة وصيانة الحياة الاجتماعية والحفاظ عليها في الدولة. فبدونه تتبلور وتتسارع وتيرة الأزمة الصحية، فيسعى الضبط الإداري إلى حماية الأفراد من جميع الأخطار التي تهدد صحته وذلك بإتباع استراتيجيات وطنية لمكافحة فيروس كورونا (كوفيد- 19). فتوصلنا إلى أنه من أجل سلامة المنظومة الصحية والوصول إلى إیجاد تدابير وقائية عملية معبرة عن حقیقة التصدي والمواجهة لجائحة كورونا، يجب أن تتظافر الجهود بين هيئات الضبط الإداري بتنفيذ هذه التدابير وتكييفها عن طريق تخفيفها أو إعادتها إلى ما كانت عليه حتى تتلاءم مع الوضع الوبائي وقدرة النظام الصحي على الاستجابة. Abstract: Legal protection is linked to the awareness of decision-makers of the importance of managing the Corona pandemic with an appropriate and effective mechanism linked to the basis of administrative control to take a form of resistance, because the particular nature of the health crisis imposes an urgent need for coordination between the various administrative control bodies to advance the health sector, which is working to contain and deal with this crisis effectively. This helps to create the balance necessary for the stability of public health and the maintenance and preservation of social life in the State. Without it, the health crisis will crystallize and accelerate, administrative control therefore seeks to protect individuals from all threats to their health by following national strategies to fight the Corona virus (Covid-19(. We therefore concluded that in order for the healthcare system to be safe and to find practical preventive measures that express the reality of the fight against the Corona pandemic, efforts must be combined between the administrative control bodies to implement these measures. and adapt them by reducing them. or bring them back to what they were in order to adapt to the epidemiological situation and the capacity of the system.
