التجارة الالكترونية في الجزائر بين الضرورة والمخاطرة

الملخص
ملخص: تعد التجارة الالكترونية في هذا العصر، بديلا حتميا عن التجارة التقليدية، غير أنها تشتمل على جملة من المخاطر، كونها تتم عن بعد وفي بيئة افتراضية يصعب فيها تحديد هوية أطرافها، كما يسهل اختراقها وقرصنتها، الأمر الذي دفعنا إلى البحث عن مدى استعداد الجزائر للولوج إلى هذا الميدان، وهي التي أحجمت عن تقنينه لسنوات طويلة، لضعف وسائل الحماية التقنية من جهة؛ وضعف البنية التحتية التكنولوجية التي تتطلبها هذه التجارة من جهة أخرى. وقد توصلنا في هذا البحث؛ إلى أن اقتحام مجال التجارة الالكترونية حتمية، وأن القانون وحده لا يكف لتطوير التجارة الالكترونية وحماية أطرافها، بل يجب مرافقته بتوسيع وتجديد البنية التحتية الرقمية والتكنولوجية، وتشجيع استخدام الانترنت، خاصة للمؤسسات الصغيرة والمتوسطة، إضافة إلى التكوين المستمر للنشء على استخدام هذه التقنيات والتحكم فيها. Abstract: Electronic commerce is considered to be an inevitable alternative to traditional commerce at the present time, but it involves a number of risks, the fact that it is carried out remotely and in a virtual environment in which the identity of its parts is difficult to determine, on the other hand it is also easy to penetrate and to hack it, This prompted us to seek the extent of Algeria’s availability to access this field, which it has refrained from legalizing for many years, due to the lack of technical means of protection on the one hand; The weakness of the technological infrastructure required by this trade on the other hand, and out of fear of the risks of penetration and piracy; What threatens resellers with this type of trade. Through this research, we concluded that entering the field of electronic commerce is inevitable and that the law alone is not enough to develop electronic commerce and protect its parties. Rather, it must be accompanied by the expansion and renewal of digital and technological infrastructure, and by encouraging the use of the Internet, particularly for small and medium-sized enterprises, in addition to continuing training of young people in the use and control of these technologies.
