أثر استزراع القوانين الأجنبية على الثقافة القانونية الوطنية

الملخص
الملخص: الثقافة القانونية ركن نبيل في أي نظام قانوني، تعبرعن نظرة مُنَظّرٍي ومُطَبّقِي عائلة قانونية، لمدلول القانون ومصادره وطرق تدريسه والتفكير فيه وتنظيمه وممارسته من لدن مهني القانون. ورغم هذه الأهمية، فإنّهَا ظلّت في نظر المقارنيين الوضعين، غير معنية بتقييم أثر سفر القوانين الأجنبية. و هو مقترب تحاول الدراسة إضعافه وتبديد مزاعمه، بالتدليل على الحاجة لمراقبة ما يرتبه استزراع القوانين الأجنبية على الثقافة القانونية الوطنية، من خلال تأصيل وتوصيف هذا المفعول الذي يبدو وانه أكثر دلالة ممّا يحدث للقواعد الوضعية. لنعرّج بعد ذلك على كيفِ هذا التأثير، بالوقوف على ما يُحدثه هذا التلقي من تغير للوسط المنهجي الأكاديمي، ومن تحوّل لممارسات مهنيي القانون. كل ذلك يمر عبر استدعاء استمدادات الإرث الطويل للنظم القانونية المقارنة ومن دون تمييز بينها، خدمة للبشرية جمعاء. Abstract: Legal culture is a noble pillar of any legal system. It expresses the viewpoint of legal theorists and practitioners of the meaning of law, its sources, methods of teaching, thinking about it, organizing it, and practicing it by legal professionals. Despite this importance, it remained in the eyes of the two comparative figures not concerned with assessing the impact of foreign laws travelling. It is an approach that study tries to dispel its claims, by demonstrating the need to monitor what entails the cultivation of foreign laws on the national legal culture, by establishing and describing this effect, which seems to be more indicative than what happens to man-made rules. Let us then look at how this effect is, by looking at what this reception brings about in terms of a change in the academic curriculum and a shift in the practices of legal professionals. All this passes by calling supplies of the long legacy of comparative legal systems, without discrimination between them, to serve all humanity.
