العقار الصناعي في القانون الجزائري بين التحفيزات و المعوقات

الملخص
رغم كل التحفيزات التي قدمها المشرع الجزائري ، من أجل جعل عملية إقتناء العقار الصناعي بالعملية السهلة ، كونها تتم عن طريق إتباع إجراءات قانونية تضمنتها الترسانة القانونية و التنظيمية ، إلا أن العملية باتت في الجزائر من أعقد الإجراءات ، جراء التصرف اللامسؤول للقائمين على هذه العملية ، و الذين يبسطون غالبا إجراءات بيروقراطية تؤثر على السير العادي ، كذلك نقص الرقابة الداخلية و الخارجية من طرف الهيئات الوصية ، ناهيك عن تصرفهم في بعض الأحيان بالذاتية و ليس بالموضوعية التي تجعل عملية الإستفادة لا تبنى على مؤشرات إقتصادية. كل هذا جعلنا نختار هذا الموضوع مستندين على المنهج التحليلي من أجل القيام بدراسة تحليلية للمنظومة القانونية و التنظيمية المتعلقة بالعقار الصناعي، و عليه اقترحنا عدة حلول من بينها الإستقرار القانوني، فرض المسؤولية على كل الهيئات و الأفراد القائمين، و إرغامهم على تحقيق نتيجة ، و ذلك بتكوينهم بغية ترسيخ ثقافة دورهم في دفع عجلة التنمية. Abstract: Despite all incentives provided by algerian legislator , in order to make the process for acquiring industrial property easy by following the legal procedures included in the legal and regulatory arsenal arsenal , the process has become in algeria one of the most complex procedures that affect the normal course , as well as the lack of internal and external oversight by the comanding bodies not to mention the sometimes subjective and not objective behavior that makes the process of benefiting , not based on economic indicators. All of this made us choose this topic based on the analytical method in order to carry out an analytical study of the legal and regulatory system related to the industrial property, and therefore we proposed several solutions including legal stability, imposing responsibility on all existing bodies and individuals, and forcing them to achieve a result, and that By training them in order to consolidate the culture of their role in advancing development.
