المسح العقاري كإجراء أولي لإثبات الملكية العقارية الخاصة في التشريع الجزائري

الملخص
تعد عملية المسح العقاري عملية فنية و قانونية تهدف إلى وضع هویة للعقار عن طريق تحديد و تثبيت مواقع العقارات و تحديد أوصافها الكاملة و تعیین الحقوق المترتبة لها أو علیها، و التعريف بالأشخاص المترتبة لهم أو عليهم هذه الحقوق، و نظرا لما تتصف به من طابع تقني دقيق فقد أوكلت المهمة إلى أشخاص و هيئات أنشئت خصيصا لذلك منها الوكالة الوطنية لمسح الأراضي، ولجنة مسح الأر اضي و المحافظة العقارية. و من أجل تطهير الملكية العقارية و تثبيتها لابد من المرور بمجموعة من المراحل الأساسية قبل تثبيت الملكية العقارية و الحصول على السند الوحید الذي یقر هذا التثبيت ألا و هو الدفتر العقاري، هذا ما یجعل العملية تعترضها جملة من الإشكاليات و النزاعات التي تؤدي لعرقلة العملية، مما یدفعنا لدراستها، بهدف إعطاء بعض الحلول الممكنة للقضاء علیها، أو على الأقل التقلیل من حدتها. : Résumé L’opération cadastrale est considérée comme une opération technique et juridique qui vise à déterminer l’identité du bien à travers la délimitation et la fixation des sites concernés et la définition de ses caractérisation complètes en identifiant les droit issus d’elle ou qui lui sont imposés y compris la présentation des individus qui ont droit ou à qui sont imposés ces derniers. En raison du caractère technique précis que cette opération revêt, cette dernière a été confié à des personnes et organismes constitués spécialement à cet effet, tel que l’agence nationale du cadastre, le comité du cadastre et la conservations foncière, et ceci en vue de fixer et clarifier les biens immeuble, et pour cela, il est indispensable de passer par une série d’étapes essentielles avant de fixer la propriété foncière et d’obtenir l’unique support qui valorise cette fixation, le livre foncier.
