إشكالات العقار والتعمير أمام الاستثمار الوطني في منظور القانون الجزائري

الملخص
حتى يشكل العقار الأرضية الأساسية لتنفيذ البرامج الاقتصادية والاستثمارية المحققة للتنمية الاقتصادية المستدامة يتطلب توفر إطار قانوني ثابت ومستقر يبعث الاطمئنان لدى المتعاملين الاستثماريين، وحمايته من الممارسات غير المشروعة التي بات يعرفها العقار كظاهرة البناء الفوضاوي الذي يعد كأهم سبب وراء تعديل سياسة التعميرية في الجزائر. وفي إطار استكمال المنظومة التشريعية المتعلقة بالاستثمار العقاري المحلي أولى المشرع الجزائري اهتماماً بالغاً بالمسائل المتعلقة بتنظيم وتسيير العقار، ومن الإصلاحات التي بادرت بها الدولة هي تحديد إطار مؤسساتي وتنظيمي لتسيير العقار وتحديد صلاحيات الفاعلين ودورهم في مجال تحسين قدرات التسيير، بالخصوص على المستوى المحلي وتجسيد لا مركزية صناعة القرار بتدعيم البلديات ومصالح العمران بالكفاءة اللازمة باستخدام التقنيات الحديثة في التسيير عن طريق إشراك جميع القوى الفاعلة، كل ذلك من أجل مسايرة تحول الحاصل في البيئة العمرانية . In order for real estate to form the basic ground for the implementation of economic and investment programs that achieve sustainable economic development, it requires the availability of a stable legal framework that reassures investment dealers, and protects it from the illegal practices that the real estate has become known for as the phenomenon of chaotic constructions. This is considered the most important reason behind the amendment of the reconstruction policy in Algeria. Within the framework of completing the legislative system related to local real estate investment, the Algerian legislator has paid great attention to issues related to the organization and management of real estate. Among the reforms initiated by the state is defining an institutional and organizational framework for managing real estate and defining the powers of actors and their role in the field of improving management capabilities, Especially at the local level and embodying the decentralization of decision-making by supporting municipalities and urban interests with the necessary efficiency, using modern technologies in management by involving all the active forces.
