مفهوم المخالفة وتطبيقاته في تفسير أحكام الزواج والطلاق قبل الدخول

الملخص
إن الأصل في مفهوم المخالفة أنه من الدلالات اللفظية المتعلقة بمفهوم النص الذي أسهب علماء الأصول في تفصيل أحكامه وضبط الاستدلال به في استنباط الأحكام الشرعية من أدلتها التفصيلية، وفي الوقت نفسه يعتبر هذا المفهوم من الوسائل التفسيرية المعتمدة والمعتبرة في فقه القانون بالإجماع التي استعارها فقهاء القانون بكل أحكامها وجزئياتها من علم الأصول واعتبروها أصلا من أصول القانون. على هذا الأساس يعتبر مفهوم المخالفة من بين أهم الآليات انسجاما وتفعيلا في تفسير وفهم نصوص قانون الأسرة المتعلقة بأحكام الزواج والطلاق قبل الدخول. Abstract : The origin of the concept of contemplation is that it is one of the verbal connotations related to the concept of the text that sholars of origins elaborated in detailing its rules and controlling the inference in deducing sharia rules from their detailed evidence ,and at the same time this concept is considered one of the approved and interpretive means in the jurisprudence of law by consensus that the jurists borrowed all its rules and parts from the science of origins , and they considered them a source of law. On this basis, the concept of contravention is considered among yhe most important mechanisms in harmony and understanding family law texts related to the provisions of marriage and divorce before entry or consummation.
