طقوس الزواج والطلاق في التوراة دراسة نقدية لسفر التثنية مقارنة بالفقه الاسلامي

الملخص
ملخص: يجد الدارس للنص التوراتي انه مر بعدة تطوراتٍ تحولات، ويبدو الامر أكثر وضوحا مع سفرٍ التثنية الذي يعد من اهم الاسفار الموجودة في التوراة، ويعد بحق وثيقة حية وواضحة لمجمل التحولات التشريعية والتاريخية والتدوينية التي مرت بها التوراة. والاحوال الشخصية وتنظيمها ما يتميز به الانسان عن غيره من المخلوقات فقد ترتبت عليها اثار حياته اجتماعية بقدر تعلق الامر بحالة الاشخاص واهليتهم او المتعلقة بنظام الاسرة كالخطبة والزواج وحقوق الزوجين وواجباتهم المتبادلة والمهر والطلاق وغيرها من المسائل. والملاحظ ان سفر التثنية اشتمل على معظم هذه المسائل وتفاصيلها. وأننا في هذه الدراسة قد ركزنا على الجانب التشريعي للزواج وطقوسه وكذلك الطلاق وما تضمنه من أسباب موجبة في سفر. الكلمات المفتاحية: الزواج، الطلاق، سفر التثنية، الفقه الإسلامي. Abstract: The student of the biblical text finds that it has gone through several developments and transformations, and the matter becomes more clear with the book of Deuteronomy, which is one of the most important books in the Torah, and is truly a living and clear document of the entire legislative, historical and codification transformations that the Torah has undergone. Personal status and its organization are what distinguishes man from other creatures, for it has had the effects of his social life as far as the situation of people and their aptitude or related to the family system such as engagement, marriage, spouses’ rights and mutual duties, dowry, divorce and other issues. It is noticeable that the Book of Deuteronomy included most of these issues and their details. And that, in this study, we have focused on the legislative aspect of marriage and its rituals, as well as divorce and the compelling reasons included in travel.
