دور المجتمع المدني في تعزيز حرية الرأي و التعبير وإنعكاسات الحراك الجزائري عليه (الجمعيات أنموذجا )

الملخص
يعتبر المجتمع المدني احد اهم الركائز في تحقيق الحكامة المجتمعية الى جانب الدولة والقطاع الخاص ، ولعل التجارب السابقة للكثير من الدول العربية التي واجهت خلال السنوات الأخيرة صعوبات خلال أزماتها مع شعوبها الطامحة للحرية والرافضة لاستبداد الحاكم كانت تعمل على إضعاف مؤسسات المجتمع المدني ، ونخص بالذكر منها دولة الجزائر التي عانت في السنوات الاخيرة من تغول السلطة التنفيذية وكبت للحريات العامة اذ أدى هذا الوضع إلى حراك شعبي دام عام في ظل غياب الوساطة الحقيقية بين السلطة و الشعب والتي تتمثل في مؤسسات المجتمع المدني المنهارة لأسباب عديدة. ولعل غياب هذه المؤسسات كرس قمع حرية الرأي والتعبير والتي تعتبر بدورها أساسا للحريات المعاصرة لانها الأساس لبلوغ الحريات الأخرى من سياسية او اقتصادية او ثقافية ...الخ . وعلية فقد اصبح اليوم من الضروري على الحكومات التي سعت لإضعاف مؤسسات المجتمع المدني ، إعادة النظر في وضع اليات قانونية لحماية هذه المؤسسات للقيام بالدور المنوط بها بغية ضمان بنية قوية للدولة مبنية على التشاركية في صنع السياسات العامة . Abstract: Civil society institutions are considered one of the most important pillars in achieving social governance alongside the state and the private sector, noting that these institutions in Arab societies did not play the intended role due to the numerous harassment and administrative that burdened the active work of civil society associations, However, these accumulations resulting from Authoritarianism and the suppression of individual liberties turned quickly to a boiling of people demanding the lifting of restrictions on public freedoms, especially mentioning Algeria, which suffered in recent years from the executive authority overruning the rest of the authorities and stifle public freedoms, as this situation led to a popular Hirak movement that lasted for a year in the absence of mediation of true mediation between the authorities and the people which are represented in the institutions of civil society collapsed for various reasons . Perhaps the absence of these institutions devoted to the suppression of freedom of opinion and expression, which is considered the basis of contemporary liberties in turn, it is the basis for achieving other freedoms, whether political, economic, cultural, etc. Therefore, it has become necessary today for the Algerian legislator to reconsider establishing legal mechanisms to protect these institutions in order to play the role entrusted to them, which is to build a strong state based on participatory public policy-making, likewise, its pivotal role is to protect freedom of opinion and expression and to communicate the voice of the vulnerable in the shadow areas of districts and villages.
