الملخص
تعتبر ظاهرة الأطفال غير الشرعيين من الظواهر الاجتماعية التي تستدعي الدراسة السوسيولوجية قصد تشخيصها والإحاطة بالعوامل المؤدية إلى انتشارها في المجتمع الجزائري، حيث أكدت مختلف التقارير وكذا الإحصائيات المقدمة من طرف الجهات الرسمية المعنية من أن هذه الفئة في تزايد مستمر، لكن هذه الإحصائيات لا تعكس الحجم الحقيقي لهذه الظاهرة لأنها تعتمد فقط على الإحصائيات المسجلة في المستشفيات، وبالتالي فعدد الأطفال غير الشرعيين أكبر من ذلك بكثير وهذه ما أكدته بعض الجمعيات المهتمة بهذه الفئة، فكثير منهم يتم الاحتفاظ به من طرف الأم ولا يتم تسجيله في قوائم الحالة المدنية، والمتتبع لهذه الظاهرة الاجتماعية تجعله يتساءل عن عوامل انتشار هذه الظاهرة في مجتمع جزائري مسلم لا يعترف إلا بالزواج الشرعي كوسيلة لتلبية الغريزة الجنسية وإنجاب الأطفال. ولذلك سنحاول تشخيص ظاهرة الأطفال غير الشرعيين ونحاول معرفة مختلف العوامل التي تساهم في ظهور هذه الفئة من المجتمع؟ Study summary: The phenomenon of illegal children is one if social phenomena that require sociological study in order to diagnose and take its factors leading to its spread in Algerian society, hence various reports as well as the statistics provided by the official authorities state that this category is growing, but these statistics do not reflect the reality of this phenomenon because it depends only on the statistics recorded in hospitals, and therefore number of illegal children is much larger and this has been confirmed by some associations that are interested in recording such statistics, many of them are adopted by a non biological mother and are not registered in civil status. The followers of this social phenomenon wonder about its high spread in the Algerian Muslim community who recognize marriage as the only legal way for people to satisfy their sexual instinct and have children. Therefore we will try to diagnose the phenomenon of illegal children and try to find out the different factors that contribute to the emergence of this category in our society?
