الملخص

ملخص : اهتم المشرع الجزائري ومن ورائه التنظيم بموضوع العمران، وأكد على ضرورة حمايته، إذ نص على العديد من الأحكام القانونية التي تقيد حق البناء، من أجل التحكم في التوسع العمراني ومنع البنايات غير الشرعية، وكلف البلدية وعلى رأسها رئيس المجلس الشعبي البلدي بمهمة الحفاظ على النظام العمراني، وذلك بموجب قانون البلدية وقانون التهيئة والتعمير، والنصوص التطبيقية له. وعليه تأتي هذه الدراسة، لبيان اختصاصات وصلاحيات الجماعات المحلية في هذا المجال، حيث تملك اختصاصات قبلية، أي قبل وقوع الأضرار بالعمران، كما تملك اختصاصات بعدية ردعية، بهدف وضع حد لمخالفة الأنشطة المختلفة لقواعد حماية العمران. Abstract: The Algerian legislator and the organization take care for the issue of urbanization, and stressed the need to protect it, it provided for several legal provisions that restricted the right to build, in order to control urban expansion and prevent illegal buildings, the Municipality, headed by the President of the Municipal People's Assembly, was tasked with maintaining the urban system, according to the municipality law and the urban law and its regulatory texts. Therefore, this study is intended to clarify the terms of reference and powers of the local administration in this field, where it have Tribal authorities to the damage to the urbanization, it also has a deterrent jurisdiction, with the aim of putting an end to the violation of the various activities of the urbanization protection rules.
