المبادئ العامة لإبرام العقود الإدارية في التشريع الجزائري ـــــ الصفقات العمومية أنموذجا ــــــــ

الملخص
الملخص تبرم الإدارة العامة العقود الإدارية بغرض تلبية حاجاتها ومن ثم تحقيق المصلحة العامة، ومن أهم هذه العقود، الصفقات العمومية، غير أن ما يميز هذه الأخيرة عن غيرها أنها تتضمن جوانب فنية معينة، ولأجل ذلك وضع لها المشرع الجزائري أحكاما تشريعية وتنظيمية مستقلة مقارنة ببعض العقود الإدارية الأخرى.هذه الأحكام كرست في المرسوم الرئاسي15/247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العمومي، حيث أولى هذا المرسوم عناية كبيرة للإجراءات المتعلقة بإبرام الصفقة العمومية واضعا لها مبادئ عامة أوجب إتباعها من قبل الإدارة العامة المتعاقدة، بغية تحقيق نجاعة الطلبات العمومية والاستعمال الحسن للمال العام. الكلمات المفتاحية: الإدارة العامة، المرافق العمومية، العقود الإدارية، الصفقة العمومية، المال العام. Abstract The public administration shall conclude administrative contracts for the purpose of the proper functioning of public utilities and then the realization of the public interest, and among the most important of these contracts are public deals , but what distinguishes the latter is that they include certain technical aspects, and for that reason the Algerian legislator has set out independent legislative and regulatory provisions compared to some Other administrative contracts. These provisions were enshrined in Presidential Decree 15/247 containing the regulation of public deals and mandates of the public facility , as this decree gave great attention to procedures related to concluding the public deal, setting general principles for it to be followed by the public contracting administration , in order to achieve the effectiveness of public requests and good use For public money.
